Congressman Espaillat Confronts ICE Facility, Demands Unfettered Access
Lawmaker cites court order in push for oversight, while concerns mount over security and due process.

Newark, NJ - Representative Adriano Espaillat (D-NY), along with Representatives Jerrold Nadler (D-NY) and Daniel Goldman (D-NY), visited the Delaney Hall detention center in Newark, New Jersey, on Wednesday, May 27, 2026, to scrutinize conditions and advocate for detainees. Espaillat, identifying as the first formerly undocumented member of Congress, presented what he claimed was a court order authorizing his entry to the facility.
Espaillat has been a vocal critic of current immigration enforcement policies, and his visit to Delaney Hall represents a continuation of efforts to challenge the authority of federal immigration agencies. He is a plaintiff in a lawsuit against the Department of Homeland Security (DHS), seeking unrestricted access to detention centers, including privately operated facilities like Delaney Hall. The lawsuit raises important questions about the balance between congressional oversight and the need to maintain security and order within detention facilities.
"I have a court order here that allows me to come in. I will go in because the Constitution protects me," Espaillat stated, asserting his right to enter the facility. However, legal experts have raised concerns about the potential for such unrestricted access to compromise the safety and security of detention centers, as well as the due process rights of detainees.
Following Espaillat's entry, Representatives Nadler and Goldman also spent approximately two hours inside Delaney Hall. Nadler voiced concerns about the conditions within the center, alleging inadequate food provisions and delayed medical treatment. He claimed detainees were fed only at 4 a.m., noon, and 4 p.m. and that maggots were sometimes present in the food. These claims have been disputed and require further investigation.
Nadler's assertions about limited medical services and delayed treatment also warrant careful examination. While access to adequate healthcare is a legitimate concern, it is essential to consider the challenges of providing medical care within a detention environment, where security protocols and resource constraints can impact service delivery. The presence of ambulances from a local Newark hospital throughout the day suggests that medical services are available, though the adequacy of those services remains a subject of debate.
Espaillat announced his intention to introduce legislation that would empower state governors to inspect federal detention centers within their states. This proposal raises concerns about the potential for state interference in federal law enforcement matters and the potential for conflicting standards and regulations. A more prudent approach would be to strengthen existing federal oversight mechanisms and ensure that ICE has the resources and training necessary to maintain safe and humane conditions within its detention facilities.
It is crucial to remember that many of those held in detention centers like Delaney Hall are awaiting deportation proceedings after having violated U.S. immigration laws. While it is important to ensure that their rights are protected and that they are treated with dignity, it is equally important to uphold the rule of law and enforce our nation's immigration laws.
The visit by the three Democratic representatives highlights the ongoing debate over immigration enforcement and the proper balance between security, due process, and humanitarian concerns. Congress should focus on enacting comprehensive immigration reform that secures our borders, streamlines the deportation process, and provides a pathway to legal status for those who are here unlawfully but are otherwise law-abiding and contribute to our society.
Furthermore, the allegations of poor conditions and inadequate medical care at Delaney Hall should be thoroughly investigated. If substantiated, appropriate measures should be taken to address these issues and ensure that all detainees are treated with dignity and respect. However, it is important to avoid generalizations and to recognize that the vast majority of ICE officers and personnel are dedicated professionals who are committed to upholding the law and ensuring the safety and security of our nation.
